These Terms & Conditions ("Terms") govern the use of the Echoes of Fun website, bookings, workshops, private events, mobile customisation services, creative experiences, products and related services provided by Echoes of Fun ("Echoes of Fun", "we", "our" or "us").

By making a booking, purchasing a product, participating in an activity or experience, or using our website, you agree to these Terms.

If you do not agree to these Terms, please do not use our website or services.

1. About Echoes of Fun

Echoes of Fun provides creative, hands-on experiences and event activities, which may include:

• Stuff Your Own Plush experiences;
• Stuff Your Own Throw Pillow workshops;
• mobile DTF customisation services;
• creative workshops;
• private events and celebrations;
• market and community event activities; and
• selected creative products and merchandise.

Activities, products, inclusions, pricing, availability and service offerings may change from time to time.

2. Age And Participation

Unless otherwise stated, Echoes of Fun experiences are designed for guests aged 5 years and over.

Guests must follow all reasonable instructions provided by Echoes of Fun staff and comply with applicable venue requirements.

Where a participant is under 18 years of age, a parent, guardian or responsible adult may be required to remain responsible for supervision, depending on the nature of the activity and venue requirements.

Echoes of Fun provides creative activities and experiences. Unless expressly agreed in writing, our services do not constitute childcare, babysitting, educational instruction, medical care or professional supervision of children.

Certain experiences may have additional age, safety or participation requirements.

Echoes of Fun reserves the right to refuse participation where it reasonably believes participation may create a risk to the safety of the participant, other guests, staff or property.

3. Bookings

Bookings are subject to availability.

A booking is not confirmed until Echoes of Fun has received the required payment, deposit, written acceptance or other confirmation specified at the time of booking.

Deposits

Echoes of Fun may require a deposit to secure a workshop, private event, mobile customisation service or other booking.

Deposit requirements, payment due dates and applicable cancellation conditions will be communicated at the time of booking.

Failure to make payment by the required date may result in cancellation of the booking.

Customer Information

Customers are responsible for providing accurate and complete information, including:

• name and contact details;
• event date and time;
• venue or event location;
• estimated guest numbers;
• selected package or experience; and
• any other information reasonably requested by Echoes of Fun.

Echoes of Fun is not responsible for delays, additional costs or service limitations resulting from inaccurate, incomplete or late information supplied by the customer.

4. Private Events

Unless otherwise agreed in writing, transportation and set-up fees are additional to the event experience price.

The final price may vary depending on:

• event location;
• number of guests;
• selected activities;
• travel requirements; and
• additional services requested.

Private event offerings may include:

• plush creation experiences;
• throw pillow stuffing workshops;
• mobile DTF customisation; and
• other creative activities.

The activities included in a booking will be those specifically agreed with the customer.

Venue Requirements

Customers must provide a safe, suitable and reasonably accessible area for the event and activity setup.

Customers must disclose relevant venue information, including:

• stairs or lift restrictions;
• parking limitations;
• loading requirements;
• power access;
• venue rules;
• limited site access; or
• any factor that may affect setup or operation.

Additional Charges

Additional charges may apply where:

• guest numbers increase after confirmation;
• additional travel is required;
• venue access delays create waiting time;
• specialised equipment is requested;
• activities are added; or
• event duration is extended.

Where reasonably practicable, additional charges will be discussed and approved before being incurred.

Responsibility for Guests

Customers remain responsible for the conduct and supervision of their guests throughout the event.

Customers are responsible for damage caused by their guests to venue property, fixtures, fittings or third-party property, except to the extent that such damage results from the negligence or legal fault of Echoes of Fun.

5. Mobile DTF Customisation

Echoes of Fun may provide mobile DTF customisation services at events.

For these services, Echoes of Fun may supply:

• DTF transfer designs;
• garments and suitable items;
• heat-press equipment; and
• associated equipment required for customisation.

Guests may select from available designs and eligible items.

All heat-press equipment will be operated by Echoes of Fun staff.

Guests must not touch, operate or interfere with heat-press equipment unless expressly instructed to do so by staff.

Heat-press equipment operates at high temperatures and may cause burns or injury if used improperly.

Design availability, garment styles, colours, sizes and stock levels may vary between events.

Echoes of Fun may refuse a customisation request where a material, item or design is unsuitable or unsafe for application.

The final appearance of a DTF transfer may vary depending on the item, fabric, transfer and application process.

6. Customer-supplied Or Customer-selected Artwork

Where a customer provides or selects artwork, names, images, logos, characters, slogans, photographs or other material for customisation, the customer warrants that they have the necessary rights, permissions or authority to use that material.

Customers must not provide material that:

• infringes intellectual property rights;
• is unlawful;
• is offensive or inappropriate for the intended audience;
• impersonates another individual or organisation; or
• creates a legal or safety concern.

Echoes of Fun may refuse to reproduce or use any material where it reasonably believes doing so may breach a law or another person's rights.

Customers are responsible for checking and approving all spelling, names, dates, artwork and customisation details before production.

7. Throw Pillow Workshops

Throw pillow workshops are hands-on experiences in which guests select, prepare and stuff a throw pillow before taking it home.

Guests must follow staff instructions at all times.

Finished products must be used, maintained and cared for in accordance with supplied care and safety information.

Customers should regularly inspect products and discontinue use if seams become damaged or filling becomes exposed.

8. Plush Creation Experiences

Plush creation experiences involve the selection, stuffing and personalisation of a plush item.

Package inclusions will be stated at the time of booking or purchase.

Guests must follow staff instructions during the activity.

The appearance of completed plush products may vary depending on selected items, accessories and personalisation choices.

All plush products should be used in accordance with supplied care and safety information.

9. Safety

Safety is an important part of every Echoes of Fun experience.

Guests must:

• follow staff instructions;
• use materials appropriately;
• remain within designated activity areas;
• avoid touching equipment identified as hazardous;
• avoid interfering with other participants; and
• immediately report accidents, damage or safety concerns.

Parents, guardians and responsible adults remain responsible for supervision of children unless otherwise agreed in writing.

Echoes of Fun may stop, amend or cancel an activity where necessary to address a safety concern.

Allergies, Medical Conditions and Special Requirements

Customers should advise Echoes of Fun before participation if they or a guest have any known:

• allergies;
• medical conditions;
• physical limitations;
• sensory sensitivities; or
• other circumstances that may affect participation.

Echoes of Fun will make reasonable efforts to accommodate disclosed requirements where practical and safe to do so.

Activities may involve fabrics, stuffing materials, inks, adhesives and decorative items that may not be suitable for all participants.

10. Heat-press Safety

Where DTF customisation services are provided, all heat-press equipment will be operated by Echoes of Fun staff.

Guests must remain clear of equipment unless directed otherwise by staff.

Echoes of Fun may establish designated safety zones around equipment and restrict access where necessary.

Customers or venues must provide a suitable operating location and access to electricity where required.

11. Photography And Video

Photography and video recording may occur at workshops, events, markets and other activities.

Images and recordings may be used for:

• social media;
• advertising;
• marketing;
• website content;
• promotional materials; and
• other legitimate business purposes.

If you do not wish to be photographed or recorded, please advise Echoes of Fun staff as soon as possible.

Where practical, parents or guardians may notify Echoes of Fun that they do not wish a child's image to be used for promotional purposes. Echoes of Fun will take reasonable steps to respect such requests.

Where specific consent is required by law, a separate consent process may be used.

12. Prices And Payment

All prices are displayed in Australian Dollars (AUD) unless otherwise stated.

Accepted payment methods may include:

• Cash;
• Card; and
• PayID.

Prices and package inclusions may change from time to time.

The price agreed for a confirmed booking will generally apply to that booking unless a change is required by law or agreed between the parties.

13. Cancellations And Rescheduling

Cancellation and rescheduling arrangements may vary depending on the booking type, customisation requirements and event circumstances.

Customers should contact Echoes of Fun as soon as possible if they wish to cancel or reschedule.

Echoes of Fun may offer a transfer, credit or rescheduling option at its discretion and subject to availability.

Acceptance of a rescheduling request is not guaranteed and may depend on staffing, venue availability, schedules and material availability.

Failure to attend a booking without notice may be treated as a non-attendance and fees paid may be forfeited, subject to Australian Consumer Law.

Where a deposit has been paid for a private event, the cancellation terms advised at the time of booking will apply.

14. Refunds, Cancellations & Customer Satisfaction Policy

At Echoes of Fun, we want every customer to enjoy their experience and be satisfied with their purchase.

14.1 Check Your Selection Before Completing Your Purchase

Customers should carefully review all selections before completing payment, including:

• products;
• colours;
• sizes;
• accessories;
• personalisation details;
• artwork selections; and
• package inclusions.

Refunds and exchanges are generally not available for change of mind after completion of a workshop, event or purchase, subject to Australian Consumer Law.

14.2 Completed Workshops and Experiences

Customers should notify staff immediately if:

• an item is damaged or defective;
• the item differs from what was ordered;
• personalisation is incorrect;
• a package inclusion is missing; or
• another issue exists.

Where possible, Echoes of Fun will attempt to resolve issues before the customer leaves the event.

14.3 Change of Mind

Refunds are generally not available for change of mind after:

• payment has been completed;
• a personalised item has been produced;
• a workshop has been completed; or
• a customer has left the venue.

This does not affect rights available under Australian Consumer Law.

14.4 Customised and Personalised Items

Customers are responsible for approving:

• designs;
• spelling;
• names;
• dates;
• colours;
• sizes; and
• selected products.

Once production commences, changes may not be possible.

14.5 Website Purchases

Customers should carefully review all orders before completing a purchase.

Online purchases are generally final once payment is completed, subject to rights available under Australian Consumer Law.

14.6 Items Must Be Used Correctly

Customers must follow all:

• safety instructions;
• age recommendations;
• care instructions;
• cleaning instructions; and
• reasonable directions provided by Echoes of Fun.

14.7 Product Damage or Defects

If a product is damaged, defective or fails to meet an applicable consumer guarantee, customers should contact Echoes of Fun promptly and provide:

• contact details;
• order information;
• date of purchase;
• description of the issue; and
• photographs where appropriate.

14.8 Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under Australian Consumer Law.

14.9 Contact Us Before Leaving

Customers are encouraged to discuss concerns with staff before leaving an event so that issues can be addressed promptly.

15. Custom Products

Customised items may be produced specifically for individual customers.

Customers should carefully check:

• spelling;
• names;
• dates;
• artwork;
• images;
• colours;
• sizes; and
• selected products.

Echoes of Fun is not responsible for errors arising from customer-approved information, subject to Australian Consumer Law.

16. Product Safety

Products must be used in accordance with supplied instructions, warnings and care information.

Customers should regularly inspect products for damage, loose components or other safety concerns.

If a product appears unsafe, use should cease immediately.

16a. Delivery Of Website Orders

Where physical products are purchased through the website, delivery timeframes are estimates only unless otherwise stated.

Echoes of Fun is not responsible for delays caused by postal operators, couriers, severe weather, industrial action, supply chain issues or other circumstances outside our reasonable control.

Customers are responsible for ensuring delivery information is accurate and complete.

Additional delivery charges may apply where products must be re-delivered due to incorrect information supplied by the customer.

Nothing in this section affects rights available under Australian Consumer Law.

17. Intellectual Property

The Echoes of Fun name, logo, branding, website content, graphics, photographs, designs and written materials are owned by or licensed to Echoes of Fun unless otherwise stated.

You must not reproduce, modify, distribute or commercially exploit Echoes of Fun content without prior permission unless permitted by law.

18. Website Information

We aim to keep website information accurate and up to date.

Images are illustrative only and colours may appear differently across devices and screens.

Availability, dates, pricing, inclusions and product offerings may change without notice.

19. Third-party Services

Echoes of Fun may use third-party providers including:

• booking platforms;
• payment processors;
• website hosting providers;
• delivery services;
• venues; and
• communication services.

These providers may have their own terms and privacy policies.

20. Privacy

Echoes of Fun may collect personal information necessary to provide services and conduct business operations.

• customisation materials supplied by customers.

Personal information will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.

All marketing communications will comply with applicable Australian spam legislation.

22. Photographs, Artwork And Customer Content

Where customers provide reviews, photographs, artwork or other content, they confirm they have authority to provide that material.

Echoes of Fun will not knowingly use customer content in a manner that infringes the rights of third parties.

23. Events Outside Our Control

Circumstances beyond our reasonable control may affect bookings and events, including:

• severe weather;
• power outages;
• transport disruptions;
• venue closures;
• emergencies;
• government restrictions;
• unsafe conditions; or
• equipment failures.

Where possible, Echoes of Fun will communicate with customers and may offer rescheduling or another reasonable alternative.

23a. Limitation Of Liability

Nothing in these Terms excludes, restricts or modifies rights, guarantees or remedies that cannot lawfully be excluded under Australian law.

To the fullest extent permitted by law:

• Echoes of Fun excludes liability for indirect, consequential, incidental and special loss or damage;
• Echoes of Fun is not liable for circumstances outside its reasonable control; and
• where liability cannot be excluded, liability is limited to the remedies available under applicable law, including Australian Consumer Law.

24. Complaints

If you have a concern about a booking, product or service, please contact us as soon as possible and provide:

• your name;
• booking or order details;
• the relevant date; and
• details of the issue.

We will review the matter and respond within a reasonable period.

25. Accessibility And Inclusion

Echoes of Fun is committed to providing welcoming and inclusive experiences.

Customers are encouraged to discuss accessibility requirements before booking so that reasonable arrangements can be considered.

26. Changes To These Terms

Echoes of Fun may update these Terms from time to time.

The current version will be published on the website.

Changes will not retrospectively remove rights that have already arisen under applicable law.

27. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any dispute relating to these Terms will be determined in accordance with applicable Australian law.

Nothing in these Terms limits any rights available under Australian Consumer Law.
